2. Scope of Services
Vibe with AI provides AI consulting, architecture, and implementation services for businesses, and develops and publishes its own software applications (such as By Design, available on the Apple App Store). The specific scope, deliverables, and fees for each consulting engagement are agreed upon individually and formalised in a separate service agreement or proposal. Your use of our applications is additionally governed by the applicable app store terms and any end-user licence or in-app terms presented within the app (see Section 9).
3. Acceptance of Terms
By accessing and using this website you agree to be bound by these terms and conditions. If you do not agree, please discontinue use of the website immediately.
4. Intellectual Property
All content on this website and in the software applications we publish — including text, graphics, logos, design, and code — is the property of Vibe with AI or its licensors and is protected under Portuguese and EU intellectual property law (Código do Direito de Autor e dos Direitos Conexos). You may not reproduce, distribute, or create derivative works without prior written consent.
5. User Obligations
- You agree to use the website only for lawful purposes and in compliance with applicable Portuguese and EU law.
- You must not attempt to gain unauthorised access to any part of the website or its underlying systems.
- Information you provide through contact forms or bookings must be accurate and complete.
6. Limitation of Liability
To the fullest extent permitted by Portuguese law (Código Civil, Article 483 et seq.), Vibe with AI shall not be liable for any indirect, incidental, or consequential damages arising from use of this website or reliance on its content. The website and its content are provided "as is" without any warranties, express or implied.
7. External Links
This website may contain links to third-party websites (including Calendly, YouTube, LinkedIn, and others). Vibe with AI is not responsible for the content, privacy practices, or availability of those external sites.
8. Service Agreements
These website terms do not govern the delivery of consulting or implementation services. Such engagements are subject to separate, individually negotiated contracts. In the event of a conflict between these terms and a signed service agreement, the service agreement prevails.
9. Software & Applications
The software applications we publish (such as By Design) are licensed, not sold, to you. Applications distributed through the Apple App Store are also subject to Apple's standard Licensed Application End User License Agreement and the App Store Terms of Service, in addition to any in-app terms we present.
Subscriptions and in-app purchases are processed and billed by Apple. They renew automatically unless cancelled, and can be managed or cancelled in your App Store account settings; we do not process or store your payment details.
Our applications are provided "as is". We may update, modify, or discontinue an application or any of its features at any time. Where AI features are offered, generated suggestions are provided for guidance only and should not be relied upon as professional, medical, financial, or legal advice.
10. Amendments
We reserve the right to modify these terms at any time. Changes take effect upon publication on this page. Continued use of the website after changes constitutes acceptance of the revised terms.
11. Applicable Law & Jurisdiction
These terms are governed by and construed in accordance with the laws of the Portuguese Republic. Any disputes shall be submitted to the competent courts of Portugal, without prejudice to any mandatory consumer protection rules under EU law (Regulation (EU) No 524/2013 — Online Dispute Resolution).
12. Consumer Dispute Resolution
In accordance with Portuguese Law No. 144/2015 and EU Regulation 524/2013, consumers may use the European Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr.
