1. Data Controller

The data controller responsible for your personal data is Nikolas Jaeger, trading as Vibe with AI, based in Portugal.

2. Legal Framework

This policy complies with the General Data Protection Regulation (GDPR — Regulation (EU) 2016/679), as transposed into Portuguese law by Law No. 58/2019 of 8 August (Lei de Execução Nacional do RGPD), and the Portuguese Electronic Commerce Act (Decree-Law No. 7/2004).

3. Scope of This Policy

This policy applies to the Vibe with AI website (vibewith-ai.com), our consulting services, and the software applications we publish — such as By Design, a goal-alignment and habit-tracking app for iPhone. Sections 4–9 describe the data we process through the website and consulting services; Section 10 (Software & Apps) describes how our applications handle your data. Where an app's App Store privacy details differ from this policy, those details take precedence for that app.

4. Data We Collect

Through our website and consulting services, we may collect the following personal data:

  • Contact form submissions: name, email address, and message content — provided voluntarily when you reach out to us.
  • Booking data: name, email, and scheduling information processed through Calendly when you book a call.
  • Newsletter subscription: email address provided when you subscribe via Kit (formerly ConvertKit).
  • Analytics data: anonymised usage data collected by Vercel Analytics (page views, referrer, country). No cookies are used for this purpose.

5. Legal Basis for Processing

We process your personal data on the following legal bases (Art. 6 GDPR):

  • Consent (Art. 6(1)(a)): when you voluntarily submit a contact form, book a call, or subscribe to our newsletter.
  • Legitimate interest (Art. 6(1)(f)): for anonymised website analytics to improve our services.
  • Contract performance (Art. 6(1)(b)): when processing is necessary to provide requested services.

6. How We Use Your Data

  • To respond to your enquiries and provide requested services.
  • To schedule and manage consultation bookings.
  • To send newsletters you have opted into (you can unsubscribe at any time).
  • To understand website usage patterns through anonymised analytics.

7. Third-Party Processors

We use the following third-party services that may process your data:

  • Resend — email delivery for contact form submissions.
  • Calendly — scheduling and booking management.
  • Kit (ConvertKit) — newsletter and email marketing.
  • Vercel — website hosting and anonymised analytics.

Our software applications rely on additional processors — including Apple (Sign in with Apple and subscriptions), Anthropic (AI features), and Unsplash (in-app image search) — described in Section 10 (Software & Apps).

Some of these providers are based outside the EU/EEA. Where applicable, transfers are safeguarded by Standard Contractual Clauses (SCCs) approved by the European Commission or by the provider's adherence to the EU-US Data Privacy Framework.

8. Cookies

This website does not use tracking cookies. Vercel Analytics is privacy-friendly and does not rely on cookies. Third-party embeds (Calendly, Kit) may set their own cookies — please refer to their respective privacy policies for details.

9. Data Retention

We retain your personal data only for as long as necessary to fulfil the purposes for which it was collected, or as required by law. Contact form data is retained for up to 12 months. Newsletter subscriptions remain active until you unsubscribe.

10. Software & Apps

Vibe with AI publishes software applications, including By Design (a goal-alignment and habit-tracking app for iPhone). This section describes how those apps handle your data. Where an app's behaviour differs from what is described here, that app's App Store privacy details take precedence for that app.

Account & identity. When you sign in to By Design, we use Sign in with Apple. Apple provides your name and email address so we can create your account. This information is stored on your device and is used only to personalise the app and identify your account. We do not sell it or share it for advertising.

Your content. Everything you create in the app — visions, yearly goals, habits, milestones, check-ins, rewards, and reminder preferences — is stored on your device using Apple's on-device database (SwiftData). This content is not uploaded to our servers for storage and is not visible to us.

AI features. Some features use AI to help you refine a vision, suggest goals or habits, or run a "SMART" check on a goal. When you choose to use one of these features, the app sends the relevant text you wrote (for example, your vision or goal statement and the life-area it belongs to) to our processing service, which relays it to our AI provider (Anthropic) to generate a response. These requests do not include your name, email, or any account identifier — only the goal-related content you are working on. We do not use this content to build advertising profiles, and we do not retain it beyond what is needed to generate and return your result.

Image search. If you use the in-app image search (a premium feature) to illustrate a vision, your search term and the image you select are processed through our service, which relays the request to Unsplash. Unsplash's own privacy policy governs their handling of that request.

Notifications. By Design schedules reminder notifications locally on your device. We do not operate a remote push-notification server, and reminder delivery does not send your data anywhere.

Subscriptions. Premium subscriptions are processed by Apple through the App Store. We never receive your payment details; we only receive your subscription status from Apple to unlock premium features.

Analytics & tracking. By Design contains no third-party analytics, advertising, or tracking technologies. We do not track you across other companies' apps or websites.

Your choices. You can sign out or delete your account at any time from the app's Settings. Deleting your account removes your content from your device. For any privacy question, contact us at nikolas.jaeger86@gmail.com.

11. Your Rights (RGPD/GDPR)

Under the GDPR and Portuguese Law 58/2019, you have the right to:

  • Access your personal data (Art. 15).
  • Rectify inaccurate data (Art. 16).
  • Erase your data — "right to be forgotten" (Art. 17).
  • Restrict processing (Art. 18).
  • Data portability (Art. 20).
  • Object to processing (Art. 21).
  • Withdraw consent at any time without affecting the lawfulness of prior processing (Art. 7(3)).

12. Right to Lodge a Complaint

If you believe your data protection rights have been violated, you have the right to lodge a complaint with the Portuguese Data Protection Authority (Comissão Nacional de Proteção de Dados — CNPD) at www.cnpd.pt.

We may update this privacy policy from time to time. Changes will be published on this page with an updated revision date. We encourage you to review this page periodically.
